Article 1. General

This website www.svr.com (hereinafter referred to as the " Site ") is published by LABORATOIRES SVR, a simplified joint-stock company with capital of 17,501,502 euros, headquartered at ZAC LA TREMBLAIE, 2 Rue de la Mare à Blot - 91220 LE PLESSIS PÂTÉ, registered in the Evry Trade and Companies Register, under number B 617 080 098, with VAT number FR59 617 080 098, and unique identifier n°FR210834_01GOMC (household packaging sector), (hereinafter referred to as " LABORATOIRES SVR ").

These general conditions of sale (hereinafter referred to as the " GCS ") govern all relations between LABORATOIRES SVR and any person wishing to purchase one or more products offered for sale by LABORATOIRES SVR on this Site.

It is specified that these GTC apply to the exclusion of all other conditions and, in particular, the General conditions of sale in force for sales made in stores, shops, pharmacies and/or parapharmacies proposing LABORATORIES SVR products.

In these General Terms and Conditions, the terms " Product " or " Products " refer to the product(s) offered for sale on the Site and dispatched by LABORATOIRES SVR.

The " Customer " refers to any consumer, i.e. any natural person, non-trading, acting in a non-professional capacity, who visits one or more web pages of the Site, whether or not he/she has initiated a purchasing process on the present Site. The Customer must have full legal capacity and be of legal age.

LABORATOIRES SVR reserves the right to modify these terms and conditions at any time by publishing a new version on its website. The terms and conditions applicable shall be those in force on the date of payment (or of the first payment in the case of payment in several instalments) of the order.

LABORATOIRES SVR also ensures that their acceptance is clear and unreserved by setting up a checkbox and a validation click.

The Client acknowledges that he has received the necessary advice and information to ensure that the offer meets his needs. The Client declares that he is in a position to enter into a legal contract under French law or to be validly represented by the natural or legal person for whom he undertakes to do so. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

Article 2. Products

2.1. Product availability

Product offers made by LABORATOIRES SVR on the Site shall remain in force as long as the Products are present on the Site, and within the limit of available stocks.

Products that are temporarily unavailable are indicated as such on the Site (" Unavailable "), and the Customer may provide his e-mail address in order to be informed when the Product is back in stock.

However, despite the care taken by LABORATOIRES SVR in the management of its stocks and the means it has implemented for this purpose, errors may exceptionally be mentioned on the state of its stocks. In this case, LABORATOIRES SVR will inform the Customer by e-mail of the unavailability of the Product(s) concerned as soon as possible. LABORATOIRES SVR will then take the necessary steps to refund the price of the unavailable Product(s). The bank account corresponding to the credit card details given at the time of ordering will then be credited with the overpayment, within thirty (30) days of the notification sent to the Customer.

The customer makes his business of any use that could be made of the products purchased on the site. The products are intended for the personal use of the customer, without any direct connection with the professional activity of the client.

2.2 Essential characteristics of the Products

Prior to placing an order, the Customer may view the essential characteristics of the Product(s) he/she wishes to order directly on the Site.

The differences between the photographs and the products can only be minimal differences and do not relate to the essential characteristics of the products.

LABORATOIRES SVR invites the Customer to refer to the description of each Product for its precise characteristics. In case of doubt or if the Customer requires further information, he may contact LABORATOIRES SVR by e-mail at the following address hello@svr.com and/or by telephone on 01.84.79.11.11 - Monday to Friday from 10am to 6pm.

However, in the event of a manifest error in the price and/or between the characteristics of a Product and its representation, the Customer undertakes to contact LABORATOIRES SVR by e-mail at the following address hello@svr.com and/or by telephone on 01.84.79.11.11 - Monday to Friday from 10am to 6pm, in order to inform them of the said manifest error. In all cases, LABORATOIRES SVR may proceed with the correction of an obvious error; the Customer having the right to cancel his order in the event of refusal of the corrected conditions.

Article 3. Prices

On the Site pages presenting the Products, order forms and invoices issued to the Customer, prices are indicated in euros inclusive of all taxes, taking into account the rate of Value Added Tax (VAT) and any reductions applicable on the day of the order.

On the Site pages presenting the Products, the prices indicated do not include delivery charges, which are invoiced in addition and are specified to the Customer prior to final validation of the order.

The prices of the products may evolve according to the commercial policy of LABORATOIRES SVR. The products will in any case be invoiced on the basis of the tariffs in force on the site at the time of the final validation of the order.

The price of each order, including the delivery fee, is payable in cash at the order taking. Failing that, no delivery shall be carried out and the sale shall be deemed cancelled at the client's initiative.

Promotional offers are valid only during the period of validity of the offer concerned, as indicated on the Site.

Article 4. Order

4.1 registering and creating an account

To place an order, the Customer must first register on the Site by creating an account.

When registering, the customer's e-mail address is used as the login. However, the customer chooses his or her own password. It is the customer's responsibility to regularly change his/her password on the "My account" page. It is strongly recommended not to choose a password consisting of a common word, but to alternate numbers and letters.

The Customer receives an e-mail confirming registration. The Customer is solely responsible for his/her password and its use. The Customer expressly undertakes to keep the password confidential and not to disclose it to any third party under any circumstances.

4.2 Registering an order

To place an order, the Customer selects the various Products he/she wishes to purchase by clicking on their details. Indicate the number of Products required and click on the "Add to Basket" button.

Each new addition in his cart is indicated to the customer in the summary of his order.

The Customer may, at any time:
- obtain a summary of the Products he/she has selected by clicking on the "View Basket" icon accessible at the top right of the screen,
- modify or delete all or part of his/her order thus summarized (in the event of modification, the new price is displayed once the Customer has clicked on the "Update" button).

When the Customer is on the "Shopping Cart" page, he can:
- continue his selection of Products by visiting another part of the Site,
- if he wishes, select 3 samples of his choice to include in his order,
- or complete his selection of Products and order them by clicking on "Checkout". 

When the Customer is on the "Order" page, he can:
- identify himself by entering his login and password (if he has forgotten or lost his password, the Customer must click on "Forgot your password?"),- if he does not have an account, the Customer can continue his order as a guest by entering his e-mail address.

As soon as the Customer creates an account, he automatically continues the order process. They then fill in their billing address and, if applicable, their delivery address, which may be different.

The customer can access the information about him by clicking on "my account". It is up to him to update the information on this page concerning him and to verify their truthfulness when placing each order.

If the Customer orders as a guest, he/she must enter his/her billing information, delivery information, delivery method and payment information. Before proceeding to payment, they will be asked to check their order.

Delivery and billing addresses entered for the first time on the site are saved as default addresses in the address book in the customer account. They may be modified or deleted at any time. However, no modification or deletion will be taken into account for any order that has been definitively validated and is currently being processed.

If the Customer already has an account on the LABORATOIRES SVR site, the Customer is directed to the "Billing Address" page, where it is the Customer's responsibility to check, complete and validate the information given there. The default delivery address is the billing address, although it may be different (particularly in the case of gifts). The customer then chooses the delivery method for sending the products. Delivery charges are specified on this "Delivery Terms" page.

If the amount of these delivery charges is acceptable, the customer clicks on the "Continue" button and is then taken to the "Payment" page, which shows the different payment methods available.

4.3 Order validation

The customer is then directed to a page "order summary" which displays the order form which presents the nature, quantity and price TTC of the products selected by the customer as well as the various charges possibly applicable.

To continue the ordering process, the customer must click on the "read sales conditions" button. These GTC are then displayed. The customer may not continue the ordering process if he does not check the box "I have read and accept the terms of sale". By ticking on the box "I have read and accept the terms of sale", the customer, materializes its full acceptance, these GTC as well as the special conditions of sale applicable to each placing of order and stated on its screen ( name of the product, price, weight, quantity, etc.).

Therefore, when the customer checks the said box, he acknowledges beforehand that they have read these GTC as well as the special conditions of sale and accept them without restriction. Once the checkbox is selected, the customer clicks "continue".

Prior to the final validation of its order, the customer can check the details of his order, his price incl. VAT, including applicable fees, and correct any errors. The customer may modify his order and/or the information concerning the billing and/or delivery address and/or cancel his order.

4.4 Abnormal order cancellation or modification

In accordance with article L121-11 of the French Consumer Code , LABORATOIRES SVR reserves the right to modify, refuse or cancel all or part of an order or several cumulative orders that are fraudulent or abnormal, in particular when the quantities ordered do not correspond to the ordinary needs of a consumer.

LABORATOIRES SVR shall inform the customer concerned as soon as possible. Such modifications or cancellations shall not give rise to any indemnity or compensation of any kind whatsoever.

Article 5. Payment

In accordance with article L. 221-14 of the French Consumer Code, the Customer is informed that orders are subject to payment. The price paid by the Customer is necessarily the price indicated on the order validated by the Customer. Payment for purchases made on the Site is made exclusively in euros (€).

Payment by cheque is not allowed. Accordingly, the client must have either a PayPal account or a credit card accepted by the Bank in charge of making the online payments (Carte Bleue, Visa, MasterCard), the validity of which will be verified and confirmed by the Bank's electronic banking institution.

When entering the data of the credit card, the customer will enter his card number and the expiration date of it as well as, possibly, the control number. The control number is the last three digits on the back of the customer's credit card.

It is specified that the details of the credit card are secured by encryption via the so-called "3D secure" system in order to protect as efficiently as possible all the data related to the means of payment, and that the data of the bank card of the Client will not be stored on the computer system of LABORATOIRES SVR, but on that of the banking institution in charge of making the payments online.

It is specified that any online payment on the Site implies an immediate debit.

Once the payment process has been completed, the Customer is directed to a page displaying the invoice for the order. The Customer may print this page.

In addition, an e-mail confirming the order, with the above-mentioned invoice, is sent to the Customer.

Article 6. Delivery

Delivery of the Products ordered by the Customer is limited to continental France, Corsica and the European countries listed in the FAQ.

6.1. Delivery times

The Products purchased will be delivered by the usual postal services, in particular by the "Colissimo 48h" service, as soon as the Products ordered have been handed over to the Post Office, and in any event no later than three (3) working days from the day following that of final validation of the order by the Customer, excluding peak periods. In the event of heavy activity, delivery times may be extended. 

The delivery times indicated are normal average times and correspond to order processing and delivery times excluding peak periods. In the event of items being delivered on different dates depending on their availability, the delivery time is based on the longest lead time. LABORATOIRES SVR reserves the right to split deliveries. However, LABORATOIRES SVR reserves the right to split deliveries, in which case the delivery charge will only be invoiced for a single shipment.

Customers are invited to regularly check the status of their order on their account and to contact LABORATOIRES SVR with any questions or problems relating to the delivery of their order by e-mail at the following address hello@svr.com.

In the event of late delivery, the Customer may notify LABORATOIRES SVR of the delay by e-mail to the following address hello@svr.com and/or by telephone on 01.84.79.11.11 - Monday to Friday, 10am to 6pm. In this case, and as long as the Product has not been dispatched, the Customer may always cancel his/her order by sending an e-mail to the following address hello@svr.com, or by sending a registered letter with acknowledgement of receipt to the following address: LABORATOIRES SVR, Service Consommateurs, 38 Cours Albert1er, 75008 Paris.

6.2. Terms of delivery

The Products ordered by the Customer will be delivered to the address indicated by the Customer on the order or, if applicable, left at the post office on which the delivery address indicated by the Customer depends, in the event that the recipient of the Products is absent. In the latter case, it is the Customer's responsibility to take the necessary steps to collect the Products from the post office within the time limit set by the latter.

After this period, if the postal services return the parcel to LABORATOIRES SVR, the latter reserves the right to invoice the Customer for any return costs.

The products purchased being routed by the usual postal services, in particular by means of the service "Colissimo 48h" of the post office, the customer must be able to prove his identity and provide, if necessary, the number assigned to his order.

6.3 Receipt of order

In accordance with the provisions of article L. 216-4 of the French Consumer Code, the transfer of risks only takes place when the Customer or a third party designated by him (neighbor, guardian, etc.), other than La Poste (in charge of delivery), takes physical possession of the parcel.

On receipt of the parcel, the Customer is invited to check the condition and contents of the parcel, and to sign the delivery note, making any comments relating to the order. They may therefore open the package before signing any transport documents.

If the Customer notices that the parcel is obviously damaged (open parcel, traces of liquid, etc.), he/she undertakes to refuse it and to request its return to LABORATOIRES SVR, which, noting the poor condition of the returned parcel, will reimburse the Customer as soon as possible.

Upon opening the parcel, if the Customer finds that the Products are damaged or do not correspond to his/her order, he/she must make a detailed claim in writing to LABORATOIRES SVR by e-mail hello@svr.com or by post to the following address: LABORATOIRES SVR, Service Consommateurs, 38 Cours Albert 1er, 75008 Paris: LABORATOIRES SVR, Service Consommateurs, 38 Cours Albert1er, 75008 Paris. The Customer shall return the Product(s) to LABORATOIRES SVR at the following address: LABORATOIRES SVR - ASAR GEMMALOG / SVR 1, rue de l'artisanat 49130, Sainte-Gemmes-sur-Loire FRANCE.

After study and on a case by case basis, LABORATOIRES SVR will be able to refund the product (or products), excluding any Exchange. The return costs will be refunded to the customer.

Refunds will be made within fourteen (14) days of receipt of the Products by LABORATOIRES SVR.

LABORATOIRES SVR shall make refunds at its discretion, either by crediting the Customer's bank account, or by bank cheque sent in the name of the Customer who placed the order, to the billing address.

The customer is committed to LABORATOIRES SVR by the information relating to his contact details and to the delivery and billing details, if these are different.

Therefore, in the event of an error in the wording of the addressee's contact details (including surname, first name, street number and name, postal code, city name, telephone number or e-mail), LABORATOIRES SVR cannot be held responsible for the impossibility in which it might be to deliver the order.

Article 7. Right of withdrawal

In accordance with the provisions of article L. 221-18 of the French Consumer Code, the Customer has a period of fourteen (14) clear days, from receipt of the Product(s) delivered, to exercise his right of withdrawal without having to justify his decision or pay any penalty. If the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it is extended to the next working day.

To exercise the right of withdrawal, the customer must notify LABORATOIRES SVR, by registered letter with acknowledgement of receipt to the following address: LABORATOIRES SVR, Service Consommateurs, 38 Cours Albert1er, 75008 Paris, or by e-mail to hello@svr.com, of their decision to withdraw by means of an unambiguous statement expressing their wish to withdraw, indicating in particular their identity, their delivery and billing address (if these are different), the order number and the date of receipt of the order. To this end, LABORATOIRES SVR provides the Customer with a model retraction form, which can be found in Appendix 1 hereto.

LABORATOIRES SVR will acknowledge receipt of the withdrawal by e-mail.

In accordance with Article L. 221-23 of the French Consumer Code, the Customer undertakes to return the Products for which he/she exercises his/her right of withdrawal, at his/her own expense, within fourteen (14) days of notifying LABORATOIRES SVR of his/her right of withdrawal.

To facilitate reimbursement, the Product(s) must be returned, complete in their original packaging (accessories, instructions, etc.) to the following address: LABORATOIRES SVR - ASAR GEMMALOG / SVR 1, rue de l'artisanat 49130, Sainte-Gemmes-sur-Loire FRANCE. However, in application of the provisions of article L. 221-28 paragraph 5°) of the French Consumer Code, the Customer will not be able to exercise his right of retraction and, consequently, return the Products, when the said delivered Products have been unsealed by him, after delivery, and consequently cannot be returned for reasons of hygiene or health protection.

If the aforementioned conditions are met, LABORATOIRES SVR shall reimburse the Customer, within a maximum period of fourteen (14) days from the date of notification of the right of withdrawal, the sums corresponding to the Products for which the Customer has exercised his right of withdrawal within the given period, including delivery costs.

However, reimbursement by LABORATOIRES SVR may be deferred until recovery of the returned Products or until the Customer provides proof of shipment of the Products, in accordance with the provisions of article L. 221-24 of the French Consumer Code.

Furthermore, LABORATOIRES SVR will not be obliged to reimburse the additional costs if the customer has expressly chosen a more costly delivery method than the delivery method proposed by LABORATOIRES SVR as part of the present.

The refund will be made via the payment method used by the customer when placing the returned order.

Article 8. Proof

The Customer expressly acknowledges that the entry of any login and password, or of any personal information in the context of an order as a guest, constitutes proof of his/her identity and manifests his/her consent to all operations that will be carried out on the Site following his/her identification.

The customer must ensure that his or her email address is valid during the period of its registration on the site, at the risk of being unable to access it, especially in the event of a loss of its password.

A customer's account is strictly personal and may not be transferred, by any means whatsoever, to a third party, even free of charge.

The Customer expressly accepts that LABORATOIRES SVR's automatic recording systems shall be considered as proof of :
- the use of the Customer's login and password, and the dates and times of such use,
- the content recorded by the Customer in the "My Account" area,
- the nature, substance, date and time of all correspondence with LABORATOIRES SVR personnel carried out using the Site or the tools offered on the Site,
- and, more generally, all information exchanged using the Site between LABORATOIRES SVR and the Customer. 

LABORATOIRES SVR shall not be held liable for any loss or damage suffered by the Customer as a result of the use of the Customer's login and password by a third party. In the event of loss, misappropriation or fraudulent use of all or part of the Customer's login and password, the Customer shall immediately notify LABORATOIRES SVR. The Customer shall remain liable for any use made of the Customer's login and password before informing LABORATOIRES SVR and before LABORATOIRES SVR has been able to modify the Customer's login and password within a reasonable period of time. In the event that a Customer disseminates or uses its identifier in a manner contrary to its intended purpose, LABORATOIRES SVR reserves the right to terminate the contract and delete access to the "My Account" space as well as any files saved, without prior notice or compensation. LABORATOIRES SVR may also take legal action to obtain compensation for any damages it may suffer as a result of such distribution or use.

These stipulations are expressly deemed to be material between the parties.

Article 9. Warranty

LABORATOIRES SVR undertakes to respect the legal guarantee of conformity set out in Articles L217-3 et seq. of the French Consumer Code, as well as the legal guarantee of defects in the item sold set out in Articles 1641 et seq. of the French Civil Code.

9.1 Legal warranty of conformity

LABORATOIRES SVR is required to deliver goods in conformity with the order placed by the Customer and shall be liable for any defects in conformity existing at the time of delivery.

The legal guarantee of conformity according to which the goods supplied to the customer must:
1- possess the qualities announced by the seller
2- be fit for the use usually expected
3- be delivered with all the accessories provided for in the contract (packaging, instructions, etc.)
4- correspond to the quantity, quality and any other characteristics announced by the seller.

(L217-3 and L217-5 Consumer Code)

When the Customer acts under the legal warranty, he :
- Has a period of 2 (two) years from the date of delivery of the goods in which to take action;
- Can choose between repair or replacement of the goods, subject to the cost conditions set out in Article L217-12 of the French Consumer Code;
- Is exempted from proving the lack of conformity of the goods during the 24 (twenty-four) months following delivery of the goods, with the exception of goods sold second-hand, where the aforementioned period is reduced to 6 (six) months. 

This legal warranty of conformity applies independently of any commercial warranties granted in addition by LABORATOIRES SVR. The customer may also exercise the warranty against hidden defects.

9.2 Warranty against hidden defects in the item sold

In addition, the customer may decide to invoke the warranty against hidden defects in the item sold, in accordance with article 1641 of the French Civil Code; in this case, the customer may choose between rescission of the sale or a reduction in the sale price, in accordance with article 1644 of the French Civil Code.

If the warranty against hidden defects is invoked, the customer has a period of 2 (two) years from the discovery of the hidden defect to take action, in accordance with article 1648 of the French Civil Code.

Article 10: Information technology and civil liberties

10.1. Protection of personal data

LABORATOIRES SVR attaches great importance to the protection of personal data and wishes to assure customers visiting the Site that their privacy is protected. The purpose of the present article is to inform customers of the processing of personal data concerning them, i.e. data enabling them to be identified, directly or indirectly, as well as their rights with regard to such processing.

Customers are hereby informed that their registration and use of the Site give rise, for LABORATOIRES SVR, to the collection and automated processing of personal data concerning them, the use of which is subject to the provisions of French Law no. 78-17 of January 6, 1978 on Data Processing, Data Files and Individual Liberties, as amended, as well as European Regulation no. 2016/679 (General Data Protection Regulation).

The customer information we collect helps us to personalize and continually improve your shopping experience. We use this information to process orders, deliver products, process payments and communicate with you regarding your orders, products, and promotional offers, keep and update our files and thus your accounts at and recommend products that may be of interest to you.

The personal data collected and processed in this way are, in particular, the following:
(i) information provided at the time of registration,
(ii) information relating to the Customer's interactions with the Site,
(iii) content saved in the "My account" space,
(iv) technical data such as, for example, the URL used by the Customer or his IP address.

Mandatory answers, without which the Customer will not be able to access the Site, are indicated as such on the Site's registration form.

The information thus collected is subject to computer processing, the purpose of which is to enable the Customer to make optimum use of the Site by accessing services, contacting LABORATOIRES SVR or placing an order.

In accordance with current legislation, customers have the right to access, modify, rectify and delete information concerning them. They also have the right to formulate specific or general directives concerning the conservation, deletion and communication of their post-mortem data, which they may exercise by writing to the following address: LABORATOIRES SVR, Service Consommateurs, 38 Cours Albert1er, 75008 Paris or by e-mail to dpo@ydes-avocats.com. This request must be signed by the Customer and include his/her contact details. The exercise of these rights requires proof of the Customer's identity.

In addition, LABORATOIRES SVR proposes to all its customers to send them by e-mail of the newsletters to which they can subscribe by informing their e-mail address in the frame and by ticking the box provided for this purpose. If a customer no longer wishes to receive such messages, he can oppose it at any time by clicking on the link provided for this purpose, present in each newsletter.

The e-mail addresses thus collected are processed for the purpose of sending the LABORATOIRES SVR newsletter. Subscribers to the newsletter have the right to access, rectify, modify and delete data concerning them, which they may exercise by sending a letter to the following address LABORATOIRES SVR, Service Consommateurs, 38 Cours Albert1er, 75008 Paris. The use of this data is exclusively reserved for LABORATOIRES SVR.

The respect of privacy and the protection of personal information transmitted by the Customer to LABORATOIRES SVR are essential and LABORATOIRES SVR shall endeavor to secure such information by implementing all means at its disposal to preserve data security and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties.

In order to better meet customer expectations, LABORATOIRES SVR may share certain information with its service providers, qualified as "subcontractors" within the meaning of the aforementioned law (e.g. for the provision of IT services, customer services). Rigorous and appropriate physical, organizational, procedural, technical and personnel measures ensure the security and confidentiality of such data. In all other cases, personal data may not be disclosed to a third party without the customer's prior consent.

LABORATOIRES SVR specifies that it has no intention of selling or marketing the Customer's personal data.

The personal data collected by LABORATOIRES SVR in connection with the creation of a customer account and the placing of order of products are kept for the time necessary for the management of orders and associated rights (guarantees, etc.), management of commercial prospecting, etc.

Some of this personal data will also be kept by LABORATOIRES SVR for the periods required by law in order to meet its legal obligations.

10.2. Use of cookies

LABORATOIRES SVR uses "cookies" to optimize the customer's use of the Site.

A "cookie" is a small text file deposited by LABORATOIRES SVR on the customer's hard disk. It enables LABORATOIRES SVR's system to remember the Customer's device when visiting the Site. The "cookies" used by LABORATOIRES SVR do not contain any personal data but only an anonymous identification number and information relating to the navigation of the computer concerned on the Site (pages consulted, date and time of consultation, etc.) which LABORATOIRES SVR may read during subsequent visits.

LABORATOIRES SVR uses "cookies" in order to optimize the Customer's use of the Site and any services. In particular, LABORATOIRES SVR uses "cookies" for the following purposes:
- To personalize the content of the Site by memorizing the Customer's preferences,
- To establish volumes of traffic and use of the various elements making up the Site,

The consent obtained by LABORATOIRES SVR from the Customer for the use of "cookies" is valid for thirteen (13) months from the date of deposit of the "cookies". At the end of this period, LABORATOIRES SVR must again obtain the Customer's consent.

Article 11 "LABORATOIRES SVR Consumer Services

Article 12. Operation of the Site

The Site is optimized for browsing with the following browsers: Internet Explorer versions 9, 10 and 11; Firefox versions 4 and higher; Chrome versions 14 and higher; Opera versions 9.25 and higher.

The Site is normally accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the control of LABORATOIRES SVR.

Furthermore, operation of the Site may be temporarily impaired or interrupted, in whole or in part and for all or some Customers, in particular for maintenance, updating or technical improvement, without prior notice. As LABORATOIRES SVR makes no commitment regarding the performance of the Site, LABORATOIRES SVR may not be held liable.

LABORATOIRES SVR shall not be held responsible for non-functioning, inability to access or malfunction of the site attributable to inappropriate equipment, malfunctions of the services of the client's access provider, to those of the network Internet. The same will be the same for all other reasons external to LABORATOIRES SVR.

Furthermore, the Customer acknowledges that the characteristics and constraints of the Internet network make it impossible to guarantee the total security, availability and integrity of data transmissions. Consequently, LABORATOIRES SVR does not guarantee that the Site will function without interruption or error.

Finally, as the Internet is accessible to all and, in particular, to ill-intentioned persons, the Customer acknowledges that LABORATOIRES SVR cannot guarantee the absolute secrecy of correspondence exchanged via the means made available on the Site.

Article 13. Customer notice verification

LABORATOIRES SVR guarantees that customer reviews appearing on the Site and marked "verified review" come from customers who have actually placed an order on the Site. Customers are invited by e-mail within 14 days of placing their order to leave a review solely on the Product(s) they have ordered.

The submission of a notice by the Customer is free of charge.

LABORATOIRES SVR reserves the right not to publish a notice that is defamatory, insulting, or unrelated to the Product(s) ordered.

Notices are filed in chronological order or, where applicable, by the filing method chosen by the Customer.

Article 14. Intellectual property rights

LABORATOIRES SVR owns all intellectual property rights and/or exploitation rights, in particular copyright, database law and trademark law, relating to the site, its content and all constituent elements.

The Site, as well as the software, database structures, texts, information, analyses, images, photographs, graphics, logos, sounds, trademarks or any other data contained on the Site remain the exclusive property of LABORATOIRES SVR or, where applicable, of their respective owners with whom LABORATOIRES SVR has concluded usage agreements.

Under no circumstances may they be reproduced, used or represented without the express written authorization of LABORATOIRES SVR, under penalty of legal action.

LABORATOIRES SVR grants the Customer a non-exclusive, personal and non-transferable right to use the Site and the original intellectual works and data it contains. The right thus granted consists of (i) a right to consult online the original intellectual works and data contained on the Site, and (ii) a reproduction right consisting of a printout and/or a backup of the original intellectual works and data consulted. This right of use is for strictly private use only.

Any other use of the Site, in particular commercial use, by the Customer is prohibited without the express written authorization of LABORATOIRES SVR.

In particular, the Customer agrees not to reproduce and/or represent for any use other than private, download, sell, distribute, issue, translate, adapt, exploit, disseminate and communicate in whole or in part in any form whatsoever, whether or not for commercial purposes, any original work of the mind or data contained on the Site.

In addition, the Site's domain name "svr.com" belongs to LABORATOIRES SVR.

Article 15. Hypertext links

Any hypertext link to the Site, regardless of the type of link, must be authorized in advance by LABORATOIRES SVR, either on paper or electronically.

The Site may include hypertext links to other websites or Internet resources external to the Site.

At the time of their creation, LABORATOIRES SVR made every effort to ensure that these web sites and other Internet resources did not contain any content in breach of French law.

However, insofar as LABORATOIRES SVR cannot constantly monitor these external sites and resources, it cannot ensure that these sites and resources always comply with legal requirements.

Consequently, LABORATOIRES SVR cannot be held responsible for the provision of these external sites and resources unless the page or Internet resource to which a hypertext link has been created contained content that contravened French law at the time it was created.

LABORATOIRES SVR therefore accepts no responsibility for the content, advertising, products and services available on or from these external sites or resources after the creation of the hypertext link on its Site. By express agreement, it is the Customer's responsibility to prove that the said hypertext link was created after the content, advertising, products or services were distributed.

Apart from this, the Customer hereby acknowledges that LABORATOIRES SVR shall not be held liable for any damage or loss, whether actual or alleged, arising from or in connection with the use of or access to the content, advertising, products or services available on these external sites or resources.

If, in the context of a search conducted on the site, the result of the website led to a client pointing at sites, pages or forums whose title and/or contents constitute an infringement of French law, in particular in view of the fact that LABORATOIRES SVR cannot control the content of these sites and external sources, it must discontinue its consultation of the site concerned except to incur the penalties provided for in French legislation or to respond to legal actions initiated against it.

Finally, if, despite the efforts of LABORATOIRES SVR, one of the hypertext links present on the site pointed to a site or an Internet resource whose content was or appeared to be inconsistent with the requirements of French law to a client, the latter undertakes to immediately contact the Director of the publication in order to provide him with the address of the pages of the site in question. LABORATOIRES SVR undertakes to study the said site and to inform the client of the follow-up which it intends to give, within a reasonable time. The client undertakes not to initiate any legal proceedings against LABORATOIRES SVR before having received a reply from him within a reasonable period of time. The client also undertakes not to initiate any legal proceedings against LABORATOIRES SVR unless he refuses to delete the said link.

Article 16. Force majeure

LABORATOIRES SVR shall not be held liable for any default, delay or non-performance of its obligations under the GCS, where such default, delay or non-performance is due to force majeure.

The following are expressly considered as force majeure or fortuitous events, in addition to those generally accepted by French jurisprudence: total or partial strikes, internal or external to LABORATOIRES SVR, lock-outs, bad weather, blockages of means of transport or supply for any reason whatsoever, governmental or legal restrictions, any epidemic accompanied by public health measures, legal or regulatory changes to forms of marketing, computer breakdowns, telecommunications blockages, failure or malfunction of transmission networks via the Internet and any other event beyond the control of the parties, preventing the normal performance of the GCS.

In addition, the Customer declares that he/she is aware of the complexity of the world's telecommunications networks, the unequal capacities of the various sub-networks, and the influx of users at certain times of the day at certain locations on the Internet. As current Internet transmission protocols do not guarantee the correct and continuous reception of messages and the integrity of transmitted documents, LABORATOIRES SVR cannot be held liable in the event of poor transmission due to a failure or malfunction of these transmission networks.

Article 17. Mediation

In the event of a dispute likely to arise in connection with these GTC, their interpretation and consequences or with the acts supplementing or modifying them, the Client shall approach LABORATOIRES SVR in order to try to obtain an amicable solution. Any complaint to LABORATOIRES SVR must be made in writing.

In the absence of amicable settlement, the Client may choose:

- to have recourse to an amicable mediation solution within a maximum period of one (1) year from the date of the Customer's written complaint to LABORATOIRES SVR by using : 

o to the LABORATOIRES SVR mediator by clicking here, or by post to Médiation de la Consommation AME, 11 Place Dauphine, 75001 Paris, France, by completing the form provided on the site, together with the documents supporting your request. The AME Médiation de la Consommation will acknowledge receipt of your request, and the designated mediator will have a period of three weeks to rule first on the admissibility of your request. He will then have three months to complete his mission, except in the case of complex cases;

o to the online dispute resolution system accessible by clicking here: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage, it being specified that the proposed mediation process is not a prerequisite for the customer to bring the matter before the competent courts;

- to bring its claim before the competent French courts.

Article 18. Final provisions

These GCS are governed by French law. Sales of LABORATOIRES SVR Products on this Site are subject to French law, regardless of the Customer's country of residence and the place where the order is placed.

The Customer has the option of registering free of charge on a BLOCTEL telephone cold calling opposition list on the https://conso.bloctel.fr/index.php/inscription.php website . in order to no longer be cold-called by a professional with whom he or she has no current contractual relationship, in accordance with French consumer law no. 2014-344 of March 17, 2014.
